Terms of use

1.) Terms
- JobEngel: A service of Solerus GmbH.
- Employee: People who are looking for work or training on JobEngel.
- Employers: Companies looking for employees or freelancers on JobEngel.
- Recruiters: Companies that search for employees on behalf of employers.
- Users: All registered persons (employees, employers, intermediaries).
- Application: JobEngel apps and websites, including connections to third-party providers.
- Search profile: Requirements created by employers or intermediaries to fill a vacancy
- Employee profile: Compilation of skills and experience created by employees.
2.) Scope of application
- These Terms of Use apply to all free and fee-based services offered by JobEngel, whether on the website, app or subpages.
- Excluded from this are "third-party services" from other providers, for which their own terms and conditions apply.
- JobEngel's GTC also apply to future transactions with users. JobEngel can change the GTC at any time and users must accept them. In the event of rejection, JobEngel may discontinue the service.
- Deviating GTC of users shall only apply if JobEngel agrees in writing.
3.) Usage, trademark and copyright law
- Solerus GmbH or its partners are the owners of the applications.
- Users may only use the applications for the intended purpose; they may not pass on or transfer the right of use.
- No property rights or licenses are transferred to the users.
- All JobEngel content is subject to copyright unless it originates from users or third parties.
- By placing an order, users confirm that they have all the necessary rights.
4.) Registration
Registration and uploading data to JobEngel is free of charge. Employers and intermediaries accept the fees according to the price list if they use paid services.
5.) User groups & general use
- JobEngel is not intended for persons under the age of 16. Their data is not knowingly collected.
- Employees may only use JobEngel privately. If they use it for business purposes, they do so at their own risk.
- Users must provide correct information when registering and report any changes immediately.
- User data may be used for internal analysis.
- The creation of search profiles by employers and recruiters is free of charge.
6.) Published data
- Profile data**: Employee profiles are only published anonymously by JoEngel, unless the employee himself releases his contact details to a requesting company.
- Inadmissible data**: JobEngel may delete jobs or data if they violate laws or the JobEngel terms and conditions. The same applies to links in data fields that lead to pages with illegal content.
- Data quality**: JobEngel may correct errors in user profiles in order to increase the quality of the data. Corrections concern spelling mistakes, replacement by existing, synonymous terms or deletion of inappropriate terms.
7.) Data protection
Employers and intermediaries must comply with the statutory data protection regulations.
8.) Use by employers and intermediaries
- Use is at your own risk.
- Employers may only use JobEngel to search for personnel. Recruiters may use it for the search and placement of employees.
- Recruiters must ensure that employees agree to the publication of their profiles.
- Employers and recruiters must ensure that they receive emails from JobEngel.
9.) End of the right of use
-After the end of the contract, all programs and data must be deleted from the user's computers, unless there are statutory retention obligations. - User rights from the contract are not transferable. - JobEngel may continue to send the user information by e-mail. The user can object to this at any time.
10.) Legal right of revocation
If you as a consumer have concluded a contract with us exclusively by telephone, Internet or e-mail, you have the legal right to withdraw from this contract:

- You can cancel the contract within 14 days without giving any reason.
- The period begins on the day on which you conclude the contract.
- To exercise your right of withdrawal, send a written declaration by post to "Solerus GmbH, Kornweg 31, 65388 Schlangenbad, Germany" or by e-mail to info@jobengel.de. You must clearly state that you wish to withdraw from the contract.
- It is sufficient if you send the revocation before the 14-day period expires.
- Consequences of withdrawal:
- If you withdraw from the contract, we will refund all payments we have received from you within 14 days. We will use the same means of payment that you used for payment, unless we agree otherwise.
- There are no fees for the refund.
- If you have used services during the withdrawal period, you must pay a reasonable amount for these services, which corresponds to the service already used in comparison to the overall performance of the contract.

11.) Invoicing and payment (employer and intermediary)
JobEngel and the user liable to pay agree that both shall provide the services specified in the contract in accordance with the terms of use and the prices valid at the time the contract is concluded.
A chargeable transaction is concluded if:
- the user clicks on the "Buy" button or
- an agent releases the profile of an employee for another agent. In this case, a monthly subscription is created, which is billed in the following month.
Unless otherwise agreed, payment for the purchase will be made by credit card debit in accordance with the current price list. All costs of the payment process (including errors in the payment details) shall be borne by the user. The payment details provided by the user when concluding the contract may be used for future payments.
For the second point (see above), billing is by invoice.
JobEngel may transfer the collection of payments to third parties and pass on the user data for this purpose, insofar as this is permitted by law.
If the fees or taxes change during a billing month, this month will be divided into two periods and billed separately.
If the user does not pay the amount within ten days of receipt of the invoice, he is automatically in default. In this case, JobEngel may charge interest on arrears and reminder fees. The reminder fee is 1.50 euros, unless the user can prove that the damage is lower.
In the event of late payment, JobEngel may claim full damages and demand default interest of 9% above the base interest rate. JobEngel can prove and claim higher damages.
Users may only offset claims against JobEngel if these are undisputed or have been established by a court. Claims of the user against JobEngel may not be assigned to third parties.
12.) Data protection, telecommunications secrecy and confidentiality
JobEngel informs the user that their data will be stored electronically and processed for the fulfillment of the contract. JobEngel collects, processes and uses personal data insofar as this is necessary for the contract and billing.
The user is advised that the web hosting provider is technically able to access the stored data in order to provide the service. Other persons on the Internet may also be able to access the data without authorization. The user is therefore responsible for protecting their own data.
If the user orders something from partner companies via JobEngel services, the necessary data will be forwarded.
The user must handle their access data (such as IDs, passwords or user names) with care and ensure that they are not passed on to third parties. If someone else uses the access data, the user is responsible unless he can prove that he was not at fault.
The user must inform JobEngel immediately if their access data is used without authorization.
If the user violates the rules stated in these terms and conditions, JobEngel may terminate the service without warning and remove the user from the site without waiving any outstanding payments.
13.) Defects & liability
JobEngel is only liable for damages if these are caused by intentional or grossly negligent behavior. Liability is limited to the amount paid by the user in the last 12 months, unless the company insurance covers the damage. If the user himself contributes to the damage, this remains unaffected.
JobEngel is only liable for advice if it is directly related to the service offered. This limitation of liability also applies to the legal representatives and employees of JobEngel. There are no claims against JobEngel if the services deviate from the agreement or are not intentionally rendered unusable.
JobEngel is not responsible for the content of linked external websites. The operators of these sites are responsible for their content.
JobEngel is not liable for false or incorrect information provided by users or technical problems in the transmission or use of the services. Defects must be reported by the user in writing and within 7 days of publication.
- In the event of a defect, JobEngel will first attempt to rectify the error. If this is not successful, the user can demand a price reduction or withdraw from the contract for individual services.
- At JobEngel's request, the user must inform JobEngel within a certain period of time whether he still insists on delivery or what claims he is asserting. In repeated cases, the user may terminate the contract.
- Claims of the user due to defects expire after one year, calculated from the time at which the defect became known or should have been known.
14.) Final provisions
The place of jurisdiction for all disputes is Schlangenbad.
Only German law shall apply to all contracts concluded on the basis of these GTCs. The UN Convention on Contracts for the International Sale of Goods and international private law are excluded.
If individual provisions of these GTCs or the contract are or become invalid, the remaining provisions shall continue to apply.
